An Act for the more effectually draining and im-
proving Lands within the Level of Hatfield Cbace,
and Parts adjacent, in the Counties ofTork, Lincoln,

HEREAS the Lands and Grounds belonging to the Partici-
pants of the Level of Hatfield Chace, and Parts adjacent, in
the Counties of York, Lincoln, and
Nottingham,
are chargeable
with the Expences of fupporting certain Works of Drainage within the
feid Level and Parts adjacent; And whereas the faid Participants are
defirous to improve the Drainage of the faid Lands and Grounds, and
alfo that the Expences thereof fhould be borne in Manner herein-after
mentioned: And whereas it is expedient that certain Provifions contained
in an A£fc, pafied in the Fifty-firft Year of the Reign of His prefent Ma^
jefty, intituled An AB for
inclojing
Lands in the Parifhes of Hatfield,
Thorne, and Fiihlake, in the Manor (f Hakefeld, in the Wejt Riding of
the
County
of Yotk, ftiould be altered j but the feveral ^utpofes aforefaid
cannot be effected without the Aid and Authority of Parliament t May
it therefore pleafe Your Majcfty that it may be enacted ; and beit enafted
by the King's moft Excellent Majefty, by and wnh the Advice and Con*
fent of the Lords Spiritual and Temporal, and Commons, in this prefent

And be it further enafted, That the faid Commiflioners fhall and
they are hereby required to hold their Firft Meeting within Two Months
next after the paffing of this Aft, and proceed in the Execution of the
Powers hereby vefted in them-, and the faid Commiflioners fhall and may
from Time to Time adjourn and hold their fubfrquent Meetings at fuch
Time or Times, Place or Places, as they (hail think moft convenient for
the due Execution of this Aft j and if at any fuch Meeting it fhall happen
that oaly One of the faid Commiflioners (hall attend fuch Meeting pur-
fuant to fuch Notice, fuch Commiflioner fhall and may adjourn fuch
Meeting from Time to Time, and ihall caufe Notice thereof in Writing
to be given to the other of the faid Commiflioners, any Thing herein con-
tained to the contrary hotwithftanding: Provided always, chat the faid
Commiflioners fhall, and they are hereby required to caufe public Notice
to be given by Advercifement to be inferted in The
Doncajier
Gazette, or
fome other Newfpaper circulated in the Counties of
Tork>
Lincoln, and
Nottingham, of the Time and Place of their Firft and every fubfequent
Meeting for the Purpofes of this Aft, Ten Days at leafl before any fuch
Meeting of the faid Commiflioners fhall be held, Meetings by Adjourn-
ment only excepted.
in.--And be it further enafted, That if either of the Commiflioners
herein nan^d, or any Commiffioner to be appointed in their or either of
thejr Place as herein-after mentioned, (ball die, refufe, negleft, or become
difabled to aft, or fhall be direftly or indireftly benefited or interefted in
any Contraft which fhall be made with any Pcrfon or Perfons by --the faid
Commiflioners, then and in every fuch Cafe it fhall be lawful for the major
Part in Value (fuch Value to be afcertained by the Land Tax Afieflaients)
of the faid Participants, who (hall attend by themfdves or their known
Agents, at any Meeting convened for that Purpofe, within Two Calen-
dar Months next after fuch Death, Refufal, Negleft, or Difability, or
Benefit or Intereft in fuch Contraft refpeftively fhall happen, be known
and; declared, to ,eleft and appoint a new Commiflioner, not interefted
in the Premifcs, in the Place of fuch Commiflioner fo dying, refufwg,
neglefting, or becoming difabled to aft, or being benefited or interefted in
fuch Contraft, of which Meeting Ten Days Notice at lead (hail be given
by theClerkjor Clerks of the faid Commiflioners in The Doncq/ier Gazette,
or income other Newfpaper as aforefaid j and every fuch Eleftion or Ap-
pointment of a new Commiffioner, fhall be reduced into Writing, and
figned by the Perfons making fuch Eleftion and Appoinrmenr, and fhall
be delivered to the furviving or remaining Commiflioner; and in cafe the
faid Participants (hall make Default in appointing any fuch new
Commif-
fioner within Two. Calendar Months next after fuch Death, Refufal,
Negleft, or Difability, or Benefit or Intercft in fuch Contraft (hall happen,
then the furviving or remaining Commiflioner ihall and may, and he is
hereby required from Time to Time, by Writing under his Hand, within
Twemy-one Days after the Expiration of the faid Two Calendar Months
allowed to.the faid Participants for naming fuch new Commiflioner as afore-
faid, to appoint One other Commiflioner in the Place of iuch

fioner fodyiftg, refufing, negleftmg, or becoming difabled to aft, or being
benefited or interefted in fuch Contraft, and every fuch Commiflioner, fo
to be appointed^ having firft taken and fubferib^d the Oath or Affirma-

IV. And be it further ena&ed, That no Perfon ihall act as a Com- Commiflion-
miflioner in the Execution of the Powers hereby given, except in the en to
take an
Power of figning and giving Notice of the Firft Meeting of the faid Com- °atk#
miflioners, until he ihall have taken and fubferibed the Oath or Affirma*
tion folio wing, (that is to fay),

Which Oath or Affirmation it (hall be lawful for either of the faid Com- CommiffioB-
miflioners to adminifter, and he is hereby required to adminifter the fame *rs to adnum-
to the other of the faid Commiflioners; and the faid Oath or Affirmation *oWotherC
To taken and fubferibed by each Commiffioner, and alfo the Inftrument &c«
of Appointment of every new Commiffioner (if any fuch there Ihall be)
with the like Oath or Affirmation to be taken by him or them, and to
be adminiftered as aforefaid, (hall be written upon Parchment, and
annexed to the Award herein-after directed to be made by the faid
Commiflioners.
V. And be it further enaifted, That put of the Money that fhall be Allowance t»
raifed for defraying the Expences of obtaining and executing this A£t, caeh Com-
there fhall be paid to each of the faid Commiflioners and Umpire, to be miffioner,
appointed as herein-after mentioned, as a Recompence for his Pains and
Trouble, the Sum of Three Pounds and Three Shillings, and no more,
for each Day he (hall be employed in travelling to, returning from, and
attending in the Execution of this Ad ; and that the faid
Commif-
fioners and Umpire fhall defray their own Travelling Expences, and
alfo their Expences at all Meetings to be held in puffuance of this
A6l; and that but One Meeting fhall be charged for by them for
any One Day.
VI.
And be it further ena&ed, That if any Difference fhall arife between Appointment
the faid Commiflioners, touching or concerning any Matter or Thing to of Umpire.
be done by them by virtue or in Execution of this Aa, whereupon the
faid Commiflioners (hall differ in Opinion, the faid Commiflioners from
Time to Time, when and fo often as fuch Difference of Opinion fhall arife,
fhall by Writing under their Hands appoint feme fit and proper Perfon
(not being inttrefted in the Premifes, nor being the Attorney or Agent
of any Perfon fo interefted) to be an Umpire between them; and the
}Matter upon which fuch Difference of Opinion Ihall or may arife, fhall be
referred to, and (hall be fettled and determined by fuch Umpire, whofe
Determination fhall be made in Writing, and fhall be binding and con-
clufive upon the faid Commiflioners, and ihall be deemed and taken to
be the Determination of the faid Commiflioners j and the faid Commit-
fioners fhall and they are hereby required tot in conformity thereto;
