CHAPTER cclxvi.
An Act to confer further powers on the Corporation of
A.D.
1900.
the County Borough of Hastings with respect to the
improvement and good government of the borough to
amend and extend provisions of the Local Acts and for
other purposes. [6th August 1900.]
"TT7HEREAS the county borough of Hastings is a municipal
» » borough under and subject to the Municipal Corporations
Act 1882 and is also a county borough under the Local Government
Act 1888 and the mayor aldermen and burgesses of the borough
acting by the council are the sanitary authority for the district of
the borough under the Public Health Act 1875:
And whereas it is expedient that further provision should be
made for the prevention of the spread of infectious diseases and
for other sanitary matters and with respect to common lodging-
houses streets and street traffic buildings esplanades seashore and
recreation grounds within the borough:
And whereas it is expedient that powers be conferred upon the
Corporation as in this Act appears in relation to the supply of
water:
And whereas the provision in suitable places of hand-stands and
the establishment of a public band or bands would conduce to the
advantage of the borough and it is expedient to confer on the
Corporation powers for the purpose :
And whereas the Corporation are the owners of the East and
West Hills and it is expedient that the Corporation should be
empowered to purchase construct and let or work lifts in relation
thereto according to the provisions of this Act:
And whereas the Corporation are the owners of the cemetery for
the borough and it is expedient that the Corporation. should be
empowered to provide suitable buildings with all necessary and
proper furnaces and appliances for the destruction of human remains
by the application of heat (in this Act called " a crematorium "j

and for the disposal of the ashes therefrom subject and according
to the provisions of this Act:
And whereas it is expedient that a fund be established for the
encouragement of thrift amoiig the officers and servants of the
Corporation and that the Corporation be empowered to subscribe
or contribute to such fund or to such officers and servants and that
the other provisions should be made in reference thereto which
are in this Act contained:
And whereas it is expedient that the Corporation should be
empowered to establish an insurance fund for the purpose of
insuring the works buildings furniture effects and property of the
Corporation against loss or damage by fire:
And whereas it is expedient that further borrowing and other
powers be conferred on the Corporation and that better provision
should be made in regard to the loans to the Corporation the
securities upon which they are charged the discharge of borrowed
money and other financial matters as in this Act mentioned:
And whereas it is expedient that the powers of the Corporation
in relation to health improvement and local government of the
borough should be enlarged and that such other provisions as in
this Act contained should be sanctioned :
And whereas it is expedient to make such amendments of the
Hastings Paving Act 1832 and the Hastings Improvement Act
1885 as this Act contains :
And whereas estimates have been prepared by the Corporation
fo.r the following purposes namely :
I1 or the construction of a lift five thousand pounds;
For providing a crematorium three thousand pounds:
And whereas the several works included in .such estimates
respectively are permanent works within the meaning of section 234
of the Public Health Act 1875 :
And whereas the objects aforesaid cannot be effected without the
authority of Parliament:
And whereas an absolute majority of the whole number of .the
council at a meeting held on the seventeenth day of November one
thousand eight hundred and ninety-nine after ten clear days' notice
by public advertisement of such meeting and of the purpose thereof
in the Hastings and St. Leonards Observer a local newspaper
published and circulating in the borough such notice being -in
addition to the ordinary notices required for summoning such
meeting resolved that the expense in relation to promoting the Bill
for this Act should be charged on the borough fund and borough
rate:
And whereas such resolution was published twice in the
Hastings and St. Leonards News a local newspaper published and

circulating in the borough and has received the approval of the
A.D.
1900.
Il Government Board:
And whereas the propriety of the promotion of the Bill for this
Act was confirmed by an absolute majority of the whole number
of the council at a further special meeting held in pursuance of
a similar notice on the fifth day of January one thousand nine
hundred being not less than fourteen days after the deposit of the
Bill in Parliament:
And whereas the owners and ratepayers of the borough by
resolution in the manner provided in the Third Schedule of the
Public Health Act 1875 consented to the promotion of the Bill for
this Act:
' May it therefore please Your Majesty that it may be enacted
arid be it enacted by the Queen's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows (that is to say):

The Lands Clauses Acts (except section 127 of the Lands incorpora-
Clauses Consolidation Act 1845 relating to the sale of superfluous g^^J
lands) so far as the same are applicable for the purposes of and

not varied or inconsistent with this Act are incorporated with
and form part of this Act.

In this Act unless the context otherwise requires Interprcta-
