Act, 1928.
CHAPTER lxxiii.
An Act to empower the mayor aldermen and A.D. I.
citizens of the city of Gloucester in the county '
of the city of Gloucester to provide and work
trolley vehicles and omnibuses to increase certain
market and fair tolls and charges and for other
purposes. [3rd August 1928.]

HEREAS the city of Gloucester in the county of the
city of Gloucester (in this Act called "the city ")
is under the management and local government of the
mayor aldermen and citizens of the city (in this Act
called " the Corporation "):
And whereas under the powers of the Gloucester
Corporation Light Railways Order 1903 the Corporation
are the owners of and are working a system of light
railways within the city and it is expedient to empower
them to provide and work vehicles adapted for use upon
roads without rails and moved by electrical power
transmitted thereto from some external source (in this
Act called " trolley vehicles ") along the routes described
in this Act along some of which routes or some part
thereof light railways have been constructed and to
confer upon the Corporation all necessary and convenient
powers in regard thereto and to empower the Minister
of Transport at any time hereafter to authorise the
working and use of trolley vehicles by the Corporation
on other roads within the area referred to in this Act:
And whereas it is expedient to confer powers upon
the Corporation for the running of omnibuses:

1928. And whereas it is expedient to authorise the abandon-
ment removal or discontinuance of any of the light
railways of the Corporation when trolley vehicles or
omnibuses have been provided and are being worked along
the roads in which any such light railways have been
constructed:
And whereas it is expedient to make further provision
with regard to the finances of the Corporation and the
application of revenue derived from their several under-
takings : '
And whereas the Corporation are the owners of
markets and fairs in the city and certain of the tolls and
charges which they are authorised to demand and take
in respect thereof are inadequate and it is expedient to
authorise the Corporation to demand and take the
increased tolls and charges set forth in this Act:
; And whereas it is expedient that the other provisions
contained in this Act be enacted :
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas estimates have been prepared by the
Corporation for the purposes hereinafter mentioned and
such estimates are as follows

For the provision of trolley vehicles - - 6,000
For the provision and adaptation of elec-
trical equipment and the construction of
other works necessary for working
trolley vehicles -. . - - - - 3,000
For the reconstruction of the roads upon
which the light railways to be removed
or discontinued under the provisions
of this Act are situate - - - 2,560
For the adaptation of buildings for the
purposes of the trolley vehicles and (
omnibuses of the Corporation ' - - 500
For the provision of omnibuses - - - 3,500
And whereas the several works included in such
estimates are permanent works and it is expedient that
the cost thereof should be spread over a term of years :
And whereas in relation to the promotion of the
Bill for this Act the requirements of the Borough Funds
Acts 1872 and 1903 have been observed ;

be enacted and be it enacted by the King's most:
Excellent Majesty by and with the advice and consent
of the Lords Spiritual and Temporal and Commons in
this present Parliament assembled and by the authority
of the same as follows (that is to say):
PRELIMINARY.
1.
This Act may be cited as the Gloucester Corpora- Short title.
tion Act 1928.
2.
The Lands Clauses Acts (so far as the same are Incorpora-
applicable for the purposes and are not inconsistent with tioxl of Acta
the provisions of this Act) are hereby incorporated with
this Act but with the following exceptions (namely) :
(a) The provisions of the Lands Clauses Consolidation
Act 1845 with respect to the purchase and taking
of lands otherwise than by agreement;
(b) Section 127 of the Lands Clauses Consolidation
Act 1845 (relating to the sale of superfluous
lands).

In this Act the several words and expressions Interpre-

Acts 1875 to 1925 have the same respective meanings
unless there be something in the subject or context
repugnant to such construction And in this Act unless
the subject or context otherwise requires
" The Corporation " means the mayor aldermen and
citizens of the city of Gloucester in the county
of the city of Gloucester;
" The city " means the city of Gloucester;
" The council" means the council of the city;
" The town clerk" and " the treasurer" mean
respectively the town clerk and the treasurer of
the city and respectively include any person
duly authorised to discharge temporarily the
duties of those offices;
" The general rate fund " and " the general rate "
mean respectively the general rate fund and the
general rate of the city or until the date when
the first new valuation list made under Part II
of the Rating and Valuation Act 1925 comes
