Council Act, 1947.
CHAPTER x.
An Act to confer further powers on the Council in regard
to their electricity undertaking lands and other matters
to make further and better provision for the improve-
ment health and local government of their district and
for other purposes. [18th July 1947.]
HEREAS the urban district of Felixstowe (in this Act
referred to as " the district ") is under the govern-
ment of the urban district council of Felixstowe (in this Act
referred to as " the Council "):
And whereas under the powers' of the Felixstowe and 2 Edw. 7.
Walton Improvement Act 1902 (hereinafter called " the Act of c- cbdu-
1902 '') the Council have constructed and are the owners of a
sea wall and a promenade in line therewith for a distance of
nearly two miles and are the owners of the foreshore beach
and sands in the district for a distance of over three miles in-
cluding the entire length of the centre of the district with the
exception of a short length under and on either side of the pier
and the Council are also the owners of over fifteen acres of
land laid out as gardens adjoining the promenade and of a
pavilion known as the " pier pavilion " situate opposite the
entrance to the pier:
And whereas the Council are the undertakers for the supply
of electricity under the provisions of the Felixstowe and
Walton Electric Lighting Order 1900 (which was scheduled
to and confirmed by the Electric Lighting Orders Confirmation 63
&
64 Vict.
(No.
1) Act 1900) and under the provisions of that Order and c- xlv1,
the Felixstowe Electricity (Extension &c.) Special Order 1928
are now supplying electricity throughout the district and the
parishes of Trimley St. Mary and Trimley St. Martin in the
rural district of Deben and it is expedient that further powers
should be conferred upon the Council with respect to their
electricity undertaking:

And whereas it is expedient that further and better pro-
vision should be made for the health good government and
improvement of the district and that the powers of the Council
in regard thereto should be enlarged as in this Act provided:
And whereas it is expedient that the provisions in regard
to the finances of the Council which are contained in this Act
should be" made:
And whereas it is expedient that the other provisions con-
tained in this Act be enacted:
And whereas the purposes of this Act cannot be attained
without the authority of Parliament:
And whereas in relation to the promotion of the Bill for this

5. Act the requirements of sections 253 254 and 255 of the Local
c- 51- Government Act 1933 have been observed:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the King's most Excellent Majesty by
and with the advice and consent of the Lords Spiritual and
Temporal and Commons in this present Parliament assembled
and by the authority of the same as follows:

Short title. 1. This Act may be cited as the Felixstowe Urban District
Council Act 1947.

This Act is divided into Parts as follows:

Part V.—Infectious disease and sanitary provisions.

Part XI.—General.
3.
The Lands Clauses Acts except sections 127 to 132 of the
Lands Clauses Consolidation Act 1845 and except the pro-
visions with respect to the purchase and taking of lands other-
wise than by agreement (so far as the same are applicable for
the purposes and are^not inconsistent, with the provisions of
this Act) are hereby incorporated with this Act.

(2) In this Act unless the subject or context otherwise
requires
, " The district " means the urban district of Felixstowe;
" The Council " means the urban district council of
Felixstowe;
" The county council " means the county council of the
administrative county of East Suffolk;
" The electricity undertaking" means the electricity
undertaking of the Council for the time being autho-
rised;
" The electricity limits " means the area within which the
Council are for the time being authorised to supply
electricity;
" The clerk " "the surveyor " "the medical officer "
and " the sanitary inspector " mean respectively
the clerk the surveyor the medical officer of health
and any sanitary inspector of the Council;
" The Minister " means the Minister of Health;
" The Lands Clauses Acts "means the Lands Clauses Acts
as modified by the Acquisition of Land (Assessment

of Compensation) Act 1919 and Part II of the Town

and Country Planning Act 1944;

" The Public Health Acts " means the Public Health Act
38 & 39

1875 and the Acts amending and extending the same; c. 55.
" Sunday school " means any school in which children
are assembled for instruction on a Sunday or
specially for religious instruction whether on a Sun-
day or not;
" Child " means a person under the age of sixteen years;
" Food " has the meaning assigned to it by section 100 of
the Food and Drugs Act 1938;

" Daily penalty " means a penalty for each day on which c' 5 '
any offence is continued by a person after convic-
tion;
" The Act of 1902 " means the Felixstowe and Walton
Improvement Act 1902:
" The general rate fund " and " the general rate " mean
respectively the general rate fund and the general
