HEREAS in the year one thousand eight hundred and eighty-
three certain persons formed themselves into a company
under the name of the Eelixstowe Gas Light Company Limited (in
this Act referred to as " the limited company ") for the purpose
(amongst other things) of supplying gas to the town of Felixstowe
in the county of Suffolk and the neighbouring places and such
company was duly registered under the Companies Act 1862: 69 Vict.
c.

And whereas by the Felixstowe Gas Order 1895 (confirmed
by the Gas Orders Confirmation Act 1895 session 2) the limited
company were empowered to maintain and continue their gasworks
and to supply gas in the parishes of Walton and Eelixstowe in the
county of Suffolk :
And whereas the share capital of the limited company autho-
rised by the Order of 1895 consists of
(A)
One thousand five hundred and ninety-four shares of five
pounds each and entitled under the Order of 1895 to a
preferential dividend of five per centum per annum
being the number of shares required to raise with the
premiums thereon the sum of eight thousand pounds;
(B)
One thousand eight hundred shares of five pounds each
being the original capital of the limited company and
entitled under the Order of 1895 to a fixed maximum
dividend of ten per centum per annum;
the whole of which capital has been subscribed and fully paid
up and the limited company have borrowed on mortgage of the
undertaking and now owe the sum of four thousand pounds:
; And whereas the limited company now supply gas at a fixed
maximum price and it is expedient that provision should be made
as in this Act contained whereby the rate of dividend payable

1904. by the Company upon their ordinary capital shall be regulated
according to the price charged for gas upon the system known as
the sliding scale of pi'ice and dividend :
And whereas the demand for gas within the limits of supply
of the limited company has increased and is increasing and it
is expedient that additional capital should be provided for the
purposes of the undertaking :
And whereas it is expedient that the limited company should
be dissolved and re-incorporated with farther powers ;
And ornini
are not now supplied with gas and it is expedient that the Com-
pany should be empowered to supply gas within those parishes :
And whereas the purposes of this Act cannot be effected
without the authority of Parliament:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the King's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows (that is to say) :
PRELIMINARY.
Short title. 1. This Act may be cited as the Felixstowe Gas Act 1904.
Incorpora- 2. The following Acts (so far as the same are applicable for
uou of A.cts. ^ purposes and are not inconsistent with the provisions of this
Act) are hereby incorporated with this Act namely :
(1) The Companies Clauses Acts 1845 to 1889 (except the
provisions with respect to the conversion of borrowed
money into capital and except Part TV. of the Com-
panies Clauses Act 1863) :
(2) The Lands Clauses Acts (except the provisions thereof
with respect to the purchase and taking of lands
otherwise than by agreement):
(3) The Gasworks Clauses Act 1847 (except sections 30 to 34)
Provided that section 35 of that Act shall be read and
construed as if the words from

in case the whole "
down to " have been paid were omitted therefrom
and that section 13 shall be read as if the words "or
any premises " were inserted after the words " private
building" in that section:
(4) The Gasworks Clauses Act 1871.
