CHAPTER v.
An Act to confirm a Provisional Order under
A.D.
1922
the Private Legislation Procedure (Scotland)
Act 1899 relating to East Lothian (Western
District) Water. [15th December 1922.]

HEREAS His Majesty's Secretary for Scotland has
after inquiry held before Commissioners made the
Provisional Order set forth in the schedule hereunto
annexed under the provisions of the Private Legislation
62 & 63
Vict.
Procedure (Scotland) Act 1899 and it is requisite that c- 47-
the said Order should be confirmed by Parliament :
Be it therefore enacted by the King's most Excellent
Majesty by and with the advice and consent of the Lords
Spiritual and Temporal and Commons in this present
Parliament assembled and by the authority of the same
as follows:

The Provisional Order contained in the schedule Confirma-
hereunto annexed shall be and the same is hereby *i°n

This Act may be cited as the East Lothian Short title.

EAST LOTHIAN (WESTERN DISTRICT) WATER.
Provisional Order to constitute and incorporate a
Board for
the supply of water to the western district of the
county
of East Lothian to transfer to the Board the water
undertakings of the county council and the Western
District Committee of the county of East Lothian and
the undertakings of the burghs of Prestonpans and
Cockenzie and Port Seton to authorise the Board to
construct additional waterworks to confer further
powers
on the Board and for
other
purposes.
WHEREAS the county council of the county of East
Lothian (hereinafter referred to as " the.county council ")
are the local authority for the county of East Lothian in
the execution of the Public Health (Scotland) Act 1897
and Acts amending the same with respect to acquiring
and holding lands rating and borrowing and the Western
District Committee of the county council (hereinafter
referred to as "the Western Committee ") are the local
authority for the execution of such Acts within the
western district of the county except with respect to
the matters before mentioned:
And whereas under the powers of the Public Health
(Scotland) Act 1897 part of the western district was by
decree of the sheriff of the Lothians and Peebles formed
into a special water supply district under the name of the
special water supply district of Prestonpans and Tranent
(landward):
And whereas the provost magistrates and councillors
of the burghs of Prestonpans and Cockenzie and Port
Seton are the local authority for their respective burghs:
And whereas the Western Committee the town
council of Prestonpans and the town council of Cockenzie
and Port Seton have combined together for the purpose
of providing a water supply to the special water supply
district of Prestonpans and Tranent (landward) and the
burghs of Prestonpans and Cockenzie and Port Seton

and a joint committee for the purpose of the manage- A.D. 1922,
ment and maintenance of the water supply to their res-
pective districts was appointed known as the Prestonpans
Combination Water Trust:
And whereas the county council under an Order of
the Local Government Board for Scotland in pursuance
of the Public Health (Scotland) Act 1897 were authorised
to purchase lands and water rights at Kidlaw in the year
one thousand nine hundred and one for the area of the
Prestonpans Combination Water Trust and by a similar
Order the county council were authorised to purchase
lands and water rights at Stobshiel in the year one
thousand nine hundred and ten for the supply of the
western district of the county of East Lothian :
And whereas the Western Committee and the town
councils of Prestonpans and Cockenzie and Port Seton
have constructed a reservoir at Kidlaw and the Preston-
pans Combination Water Trust are supplying water
therefrom within their area and the Western Committee
have constructed a reservoir at Stobshiel and are supply-
ing water therefrom within the western district of the
county:
And whereas by the Prestonpans Combination Water
Supply (Finance) Order 1912 the period for the repay-
ment of moneys borrowed for the Kidlaw water supply
was extended:
And whereas the present supply of water is insuffi-
cient for the wants and health and convenience of the
inhabitants of the area managed by the Prestonpans
Combination Water Trust and the Western Committee :
And whereas it would be to the mutual interests of
the Western Committee and the town councils of Preston-
pans and Cockenzie and Port Seton that their water
undertakings should be amalgamated :
And whereas the combined water resources of the
county council of the Western Committee and of the town
councils if fully developed and supplemented by the
supply to be obtained by the works hereinafter mentioned
will be amply sufficient to afford an adequate supply of
water not only to the districts at present supplied by
those bodies but also to certain parts of the county which
are at present supplied by other bodies and to other
parts of the county where an adequate supply of water
is urgently required: A2 3
