An Act to confirm a Provisional Order under
A.D.
1935.
the Private Legislation Procedure (Scotland)
Acts 1899 and 1933 relating to Lanarkshire
County Council. [10th July 1935.]

HEREAS the Provisional Order set forth in the
schedule hereunto annexed has after inquiry held
before Commissioners been made by one of His Majesty's
Principal Secretaries of State under the provisions of the
Private Legislation Procedure (Scotland) Acts 1899 and

1933 as read with the Secretaries of State Act 1926 and «•47-
it is requisite that the said Order should be confirmed

Be it therefore enacted by the King's most Excellent
Geo.

Majesty by and with the advice and consent of the
Lords Spiritual and Temporal and Commons in this
present Parliament assembled and by the authority of
the same as follows :
1.
The Provisional Order contained in the schedule Confirmation
hereunto annexed is hereby confirmed. sch^duie.m

This Act may be cited as the Lanarkshire Short title.

SCHEDULE.
LANARKSHIRE COUNTY COUNCIL.
Provisional Order to authorise the county council of the
county of Lanark to
acquire
lands and to
construct
a
street improvement
and
waterworks
to
extend the limits
of supply of
the
County
Council
under
the Lanarkshire
(Middle Ward District) Water Acts 1892 to 1925 to
confer
further powers upon the County Council with
regard to their water and gas undertakings and in
relation to roads buildings
and
other matters to empower
the County Council to borrow money and
make provision
for the
finance
of
the
county
to provide
that
the portion
of
the
royal
burgh
of
Renfrew
in the county
shall form
part of
the county
of
Renfrew
and for
other
purposes.
Whereas the county council of the county of Lanark
(hereinafter referred to as " the County Council") are
the local authority for the county of Lanark (hereinafter
referred to as "the county") exclusive of the burghs
therein:
And whereas it is expedient that the County Council
should be authorised to execute the street improvement
described in this Order :
And whereas by the Lanarkshire (Middle Ward
District) Water Acts 1892 to 1925 (hereinafter referred
to as " the Water Acts ") powers have been conferred on
the County Council for the construction of waterworks
and the supply of water within the limits of supply
therein defined:
And whereas it is expedient that the limits of supply
of the County Council under the Water Acts should be
extended as provided by this Order :
And whereas under the provisions of the Public
Health (Scotland) Acts 1897 to 1907 (hereinafter referred
to as " the Public Health Acts ") certain portions of the
county have been formed into special water supply
districts and it is expedient that the said special water

supply districts should cease to exist as special water A.D. 1935.
supply districts and to be assessed for the purposes of
water supply separately from other parts of the county :
And whereas it is expedient to authorise the County
Council to construct the additional waterworks described
in this Order and that the further powers with regard to
their water undertaking in this Order contained should
be conferred upon the County Council:
And whereas by the Lanarkshire Gas Orders 1914
to 1925 the Burghs Gas Supply (Scotland) Act 1876 was
in relation to the county amended in various respects
with a view to enabling the said Act to be adopted and
carried into effect within the county and provision was
made with regard to the supply of gas within the county:
And whereas it is expedient to confer upon the County
Council in relation to their gas undertaking the further
powers in this Order contained:
And whereas it is expedient that further and better
provision should be made with reference to roads and
buildings the valuation of lands weights and measures
and sale of coal and other solid fuel within the county :
And whereas it is expedient that the County Council
should be authorised to borrow money for the purposes
in this Order mentioned :
And whereas estimates have been prepared by the
County Council for and in relation to the purposes here-
inafter mentioned in respect of which they are by this
Order authorised to borrow money and such estimates
are as follows :
Street improvement

And whereas the works included in such estimates
are permanent works and it is expedient that the cost
thereof should be spread over a term of years:
