CHAPTER cv.
An Act to extend the boundaries of the borough
A.D.
1928.
of Dudley to authorise the mayor aldermen and
burgesses of the borough to execute street
works to confer further powers upon the Corpo-
ration with regard to the health local government
and improvement of the borough and for other
purposes, [3rd August 1928."]

HEREAS the borough of Dudley in the county of
Worcester (in this Act called '' the existing
borough ") is a county borough under the government of
the mayor aldermen and burgesses thereof (in this Act
called " the Corporation ") and the Corporation acting
by the council of the existing borough are the sanitary
authority for the existing borough with the powers and
obligations of an urban sanitary authority :
And whereas the unrepealed provisions of the local
Acts specified in Part I of the First Schedule to this Act
and of the Order specified in Part II of that schedule
are in force in the existing borough :
And whereas the parish of Dudley Castle Hill and
the urban district of Coseley are situate in the adminis-
trative county of Stafford and immediately adjoin the
existing borough :
And whereas it is expedient to alter and extend the
boundaries of the borough so as to include therein the
said parish of Dudley Castle Hill and part of the urban
district hereinbefore mentioned:

1928. And whereas the existing borough is co-extensive
with the parish of Dudley which forms part of the
Dudley Union which union also includes the parish of
Dudley Castle Hill and the'urban district hereinbefore
mentioned and it is expedient to alter and extend the
boundaries of the parish of Dudley so as to include
therein the areas added to the existing borough:
And whereas it is expedient to empower the Cor-
poration to construct the street works authorised by this
Act:
And whereas it is expedient to confer further
powers upon the Corporation with reference to the
acquisition of lands and also the retention disposal and
development of lands acquired by them for and in con-
nection with the execution of the street works authorised
by this Act but not required for such works :
And whereas by an indenture dated the twenty-
third day of November nineteen hundred and twenty-
five and made between the Eight Honourable William
Humble Earl of Dudley,of the one part and the Cor-
poration of the other part the castle or ruin known
as Dudley Castle together with the lands and grounds
adjoining or adjacent thereto and together with certain
other premises in the said indenture referred to were
leased to the Corporation for a period of ninety-nine
years from the twenty-ninth day of September nineteen
hundred and twenty-four subject to the covenants and
conditions contained in the said lease :
And whereas it is expedient to confirm the said
indenture and authorise the same to be carried into effect
and also to confer powers upon the Corporation with
regard to the management of the said castle or ruin and
other premises referred to in the said lease as in this Act
provided:
And whereas it is expedient to make further and
better provision with regard to the health local govern-
ment and improvement of the borough and that the
powers of the Corporation with regard thereto should
be enlarged as is provided in this Act:
And whereas it is expedient to make further pro-
vision with regard to the finances of the Corporation and
the application of revenue derived from their under-
takings :

And whereas it is expedient that the, other.pro- A.D. 1928.
visions contained in this Act should be enacted

And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas estimates have been prepared by the
Corporation for the purposes hereinafter mentioned and
such estimates are as follows : £
The purchase of lands - 92,376
The construction of the street works
authorised by this Act - - - 29,105
And whereas the several works included in such
estimates are permanent works and it is expedient that'
the cost thereof should be spread over a term of years :
And whereas in relation to the promotion of the
Bill for this Act the requirements of the Borough Funds
Acts 1872 and 1903 have been observed :
And whereas plans and sections showing the lines
and levels of the street works authorised by this Act and
also a book of reference containing the names of the
owners and lessees or reputed owners and lessees and of
the occupiers of the lands required or which may be
taken for the purposes or under the powers of this Act
were duly deposited with the clerk of the peace for the
county of Worcester and are hereinafter respectively
referred to as the deposited plans sections and book of
reference :
May it therefore please Your Majesty that it may
be enacted and be it enacted by the King's most Excellent
Majesty by and with the advice and consent of the Lords
Spiritual and Temporal and Commons in this present
Parliament assembled and by the authority of the same
as follows:
