An Act for dividing, allotting, and inclosing, and
for exonerating from Tithes, Lands within the
Township or Hamlet of
Deddithorpe
otherwise
Derrythorpe,
in the Parish of
Althorpe
in the Isle
of
Axholme
in the County of Lincoln.
[29th May 1830.]
W
HEREAS there are within the Township or Hamlet of
Deddi-
thorpe
otherwise
Derrythorpe,
in the Parish of
Althorpe
in the
Lie ofAxhoIme in the County of
Lincoln,
certain Commons
and Wastes and other Commonable Lands and Grounds, containing
together by Estimation One hundred and sixty Acres, or thereabouts:
And whereas the King's most Excellent Majesty, in right of His Crown,
is Lord of the Manor of
Epworth
in the said County of
Lincoln,
of which
Manor the Township or Hamlet of
Deddithorpe
otherwise
Derrythorpe
is
Part and Parcel; and Thomas
Lightfoot
Esquire is Lessee of the said
Manor of
Epworth by
virtue of a Lease for
a
certain Term of Years; and
His said Majesty, as such Lord of the said Manor of
Epworth,
is entitled
to the Soil of the Commons and Waste Grounds within the said Town-
ship or Hamlet of
Deddithorpe
otherwise
Derrythorpe,
and of all Mines
and Minerals within and under the same Commons and Waste Grounds:
And whereas the King's most Excellent Majesty is Patron of the Rectory

aforesaid, and James
Fenton
Clerk is the present Rector
thereof,
and as such is entitled to all the Tithes, both Great and Small,
arising, issuing, increasing, renewing, or becoming payable upon, from, or
out of all the Lands and Tenements within the said Township or Hamlet
of
Deddithorpe
otherwise
Derrythorpe
subject or liable to the Payment of
Tithes: And whereas William
Popplewell Bellingham Johnson
Esquire,
William
Rhodes,
Charles
Hasslewood,
Thomas
Hasselby,
Jonathan
Bean*
and divers other Persons, are respectively the Owners or Proprietors of
Lands and Grounds within the said Township or Hamlet of
Deddithorpe
otherwise
Derrythorpe
in the Parish of
Althorpe;
and such Persons and
also divers other Persons are respectively Owners or Proprietors of
Messuages, Cottages, Tofts and Toftsteads, Lands and Tenements, within
the said Township or Hamlet, and in respect of their respective Interests
are or claim to be severally entitled to Rights of Common and other
Rights and Interests in, over, and upon the said Commons, Wastes, and
other Commonable Lands and Grounds within the said Township or

Reign of His late Majesty King

the Third, intituled An Act fir
consolidating in One
Act
certain Provisions usually inserted in Acts
of Inclosuri,
and for
facilitating
the Mode of
proving
the
several Facts usually required

on
the passing
of
such
Acts : And whereas another Act was passed in the
First and Second Years of the Reign of His present Majesty King
George
the Fourth, intituled An Act
to amend
the Laws
respecting
the
inclosing
ef
Open
Fields,
Pastures,
Moors,
Commons,
and Waste Lands
in England : And
whereas the said Commons and Wastes and other Commonable Lands
and Grounds within the said Township or Hamlet are in their present
State incapable of any considerable Improvement, and it would be of
great Benefit and Advantage to the several Persons interested therein
if the said Commons and Wastes and other Commonable Lands and
Grounds within the said Township or Hamlet were divided and incloseiL,
and specific Shares thereof allotted to the several Owners and Pro-
prietors thereof and Persons interested therein, in specific Shares, m
proportion to their several and respective Estates, Interests, and Pro-
perties in, upon, and over the same; and it would be advantageous
to the Parties interested if, in consideration of an adequate Compen-
sation and Equivalent, the said Commons and Wastes were exonerated from
Tithes; but the several beneficial Purposes aforesaid cannot
be
effected with-
out the Aid and Authority of Parliament: May it therefore please Your
Majesty that it may be enacted; and be it enacted by the King's most
Excellent Majesty, by and with the Advice and Consent of the Lords
Spiritual and Temporal, and Commons, in this present Parliament assem-
bled, and by the Authority of the same, That the said recited Act passed
in the Forty-first Year of the Reign of His late Majesty, and all and every
the Powers, Provisions, Exemptions, Penalties, Forfeitures, Payments,
Remedies, Matters, and Things therein contained, (save and except such
Parts thereof as are expressly varied, altered, or repealed by the said
recited Atf passed in the First and Second Years of the Reign of* His
present Majesty,) and also the said recited Act passed in the First and
Second Years of the Reign of His said present Majesty, and all and
every the Powers and Provisions therein contained, shall respectively, so
far as the same respectively are applicable to this Act, and as are not
hereby varied, altered, or repealed, or otherwise provided for, be
as
good,
valid, and effectual, to all Intents and Purposes, for carrying this Act into
i execution
