An Act to extend the boundaries of the borough of Darlington to empower the corporation of Darlington to construct a weir across the river Tees and street improvements to confer further powers upon them with regard to their water electricity and markets undertakings and the health local government and improvement of the borough and for other purposes.

An Act to extend the boundaries of the borough a.d. 1930. of Darlington to empower the corporation of Darlington to construct a weir across the river Tees and street improvements to confer further powers upon them with regard to their water electricitj^ and markets, undertakings and the health local government and improvement of the borough and for other purposes. [10th July 1930.] "tTTHEREAS the borough of Darlington (in this Act VV referred to as " the borough") is a municipal borough subject to the Acts relating to municipal corporations and is a county borough within the meaning of the Local Government Act 1888 and is subject to the jurisdiction of the mayor aldermen and burgesses of the borough (in this Act referred to as " the Corporation ") : And whereas the borough now comprises the parish of Darlington such parish being co-extensive with the borough : And whereas the parishes of Haughton-le-Skerne Archdeacon Newton Blackwell and Whessoe in the rural district of Darlington in the administrative county of Durham adjoin the borough : And whereas it is expedient that the boundaries of the borough and of the parish of Darlington should be extended bo as to include therein the parts of the [Price 4s. Net.] A 1 [Ch CXXi.l Darlington Corporation [20 & 21 Geo. 5.] Act, 1930. \ D 1930 said parishes of Archdeacon Newton Blackwell Haughton-__ ' le-Skerne and Whessoe which are described in this Act: And whereas the unrepealed provisions of the several Acts Provisional and other Orders specified in the First Schedule to this Act are immediately prior to the passing of this Act in force within the borough and it is expedient that those Acts and Orders as amended by this Act should (subject as in this Act provided) apply throughout the borough as extended by this Act: And whereas in order to raise the level of the water in the river Tees it is expedient that a weir with sluices should be constructed across the said river as by this Act provided: And whereas the Corporation are the owners of a water undertaking and it is expedient that such further provision as is contained in this Act should be made with regard to the said undertaking: And whereas it is expedient that the Corporation should be empowered to construct street improvements in the borough and to acquire lands for that and other purposes : And whereas it is expedient that further powers should be conferred upon the Corporation with respect to their electricity undertaking: And whereas the Corporation are the owners of the markets undertaking in the borough and it is expedient to enlarge the powers of the Corporation, with respect to that undertaking: And whereas it is expedient that further and better provision should be made with reference to streets buildings infectious disease and sanitary matters and otherwise for the local government health improvement and finance of the borough and that the powers of the Corporation in relation thereto should be enlarged and extended: And whereas estimates have been prepared by the Corporation in relation to the following purposes in respect of which they are by this Act authorised to borrow money and such estimates are as follows: £ For the construction of the weir and works in connection therewith and for the purchase of lands therefor 4,300 2 [20&21 Geo. 5.] Darlington Corporation [Cll. For the purchase of land for and for £ A.D. 1930. the construction of a new street and street widenings and im provements - 59,000 And whereas the several works included in the said estimates respectively are permanent works and it is expedient that the cost' thereof should be spread over a term of years as by this Act provided : And whereas it is expedient that the other powers contained in this Act should be conferred : And whereas the objects of this Act cannot be attained without the authority of Parliament: And whereas plans and sections showing the lines and levels of the works to be authorised by this Act and a book of reference to the plans containing the names of the owners or reputed owners lessees or reputed lessees and of the occupiers of the lands required or which may be taken for the purposes or under the powers of this Act were duly deposited with the clerks of the peace for the counties of Durham and the north riding of York which plans sections and book of reference are in this Act respectively referred to as the deposited plans sections and book of reference: And whereas in relation to the promotion of the Bill for this Act the requirements of the Borough Funds Acts 1872 and 1903 have been observed : May it therefore please Your Majesty that it may be enacted and be it enacted by the King's most Excellent Majesty by and with the advice and consent of the Lords Spiritual and Temporal and Commons in this present Parliament assembled and by the authority of the same as follows (that is to say) : Part I. Preliminary. This Act may be cited as the Darlington Short title. Corporation Act 1930. This Act is divided into Parts as follows : Division of Part I.Preliminary. Act into Parts Part II.Extension. The following Acts and parts of Acts (so far tionofActs. as the same are applicable for the purposes and are not inconsistent with the provisions of this Act) are hereby incorporated with this Act (namely) : The l^ands Clauses Acts with the following exception and modification (namely): Section 127 of the Lands Clauses Consolidation Act 1845 (relating to the sale of superfluous lands) is not incorporated with this Act: The, bond required by section 85 of the, Lands Clauses Consolidation : Act 1845 shall, be under the corporate seal of the Corporation and shall be sufficient without the addition of the sureties mentioned in that section. Subject to the provisions of this Act and unless tion. the subject or context otherwise requires the several words and expressions to which by the Acts wholly or partially incorporated with this Act and by the Public Health Acts meanings are assigned shall in this Act have in relation to the relative subject matter the same respective meanings And in this Act " The appointed day" means the first day of October one thousand nine hundred and thirty; " The existing borough " means the county borough of Darlington as it exists at the' passing of this Act; " The borough" means until the appointed day the existing borough and thereafter the existing borough as extended by this Act; " The parish " means the parish of Darlington as extended by this Act;. 4 [20.&.21 Geo, 5.] Darlington Corporation [Ch. CXXi.] Act, 1930. " The council " means the council of the borough; A.D. 1930. "The Corporation" means as the context requires the mayor aldermen and burgesses of the existing borough or of the borough acting by the council; " The mayor " " the town clerk " " the treasurer " " the medical officer." " the surveyor " " the sanitary inspector " and " the markets superintendent " mean respectively the mayor the town clerk the treasurer the medical officer the surveyor the sanitary inspector and the markets superintendent of the borough and include any person duly authorised to discharge temporarily the duties of those officers; " The Act of 1854 " means the Darlington Local Board Act 1854; " The Act of 1861 " means the Darlington Local Board Act 1861; " The Act of 1872 " means the Darlington Extension and Improvement Act 1872; " The Act of 1925 " means the Darlington Corporation (Transport &c.) Act 1925; " The general rate fund " and " the general rate " mean respectively the general rate fund and the general rate of the borough; " The borough map " means the map marked " Map " of the borough of Darlington as extended by " the Darlington Corporation Act 1930 " and signed in triplicate by the Right Honourable the Earl of Donoughmore the Chairman of the Committee of the House of Lords to whom the Bill for this Act was referred one copy of which has been deposited in the Parliament Office of the House of Lords one in the Committee and Private. Bill Office of the House of Commons and one with the town clerk at his office; " The ward map " means the map marked " Map of " the wards of the borough of Darlington as " extended by the Darlington Corporation Act " 1930 " and signed in triplicate by the Right Honourable the Earl of Donoughmore the Chairman of the Committee of the House of Lords to whom the Bill for this Act was referred 5 [Ch.
