CHAPTER xxxv.
An Act to amend the provisions of the Colne
A.D.
1933.
and Marsden Local Board Act 1881 with respect
to compensation water to confer further powers
upon the corporation of Colne with respect to
their water gas and electricity undertakings to
enact further provisions with respect to the
transport services in the borough and elsewhere
to make better provision for the health local
government and finance of the borough and for
other purposes. [18th July 1933.]

HEREAS the borough of Colne (in the preamble
to this Act called " the borough ") is a municipal
borough subject to the Acts relating to municipal
corporations and the mayor aldermen and burgesses
of the borough (in the preamble to this Act called
"the Corporation") acting by the council of the
borough are the urban sanitary authority for the
borough :
And whereas by section 15 (Power to make water-
works) of the Colne and Marsden Local Board Act
1881 (in the preamble to this Act called " the Act of
1881 ") the Corporation (in their capacity of a local
board) were authorised to construct certain water-
works including an impounding reservoir to be called
Laneshaw reservoir for the purpose of collecting im-
pounding taking using getting and appropriating so

1933. much of the waters of the river Laneshaw and its
tributaries as might be intercepted by the said works :
And whereas by section 16 (Compensation water)
of the Act of 1881 the Corporation are required during
every working day between the hours of five o'clock in
the forenoon and five o'clock in the afternoon to
discharge into the river Laneshaw from the said reservoir
in a continuous flow a quantity of compensation water
equivalent to four hundred and eighty-two thousand six
hundred and forty gallons every twenty-four hours :
And whereas the reservoir was duly constructed
and the waters impounded thereby are now being
supplied by the Corporation for the purposes of their
water undertaking :
And whereas the Corporation have constructed a
well and pumping station at Wye oiler which well and
pumping station (with other works) were sanctioned
by the Colne Corporation Act 1905 and are used by
the Corporation solely for pumping water into a tributary
of the said river Laneshaw known as Wycoller Beck :
And whereas the demand for water within the
limits for the supply of water by the Corporation has
increased and is increasing and is likely further to
increase :
And whereas it is expedient that the obligations
of the Corporation with regard to the discharge of
compensation water into the said river should be varied
as in this Act provided and that further powers should
be conferred upon the Corporation with respect to
their water undertaking:
And whereas it is expedient that further powers
should be conferred upon the Corporation with respect
to their gas and electricity undertakings and with
respect to the acquisition use and disposal of land by
the Corporation as by this Act provided :
And whereas the Corporation were empowered by
the Colne Corporation Act 1913 to acquire by agreement
the Kght railway undertaking of the Colne and Trawden
Light Railways Company and in pursuance of the
powers of the said Act the Corporation became the
owners of a system of tramways or light railways in
the borough and in the urban district of Trawden :

And whereas by the Colne Corporation Act 1921 A.D. 1933.
the Corporation were empowered to discontinue the
whole or parts of the said tramways or light railways
and to run omnibuses or public service vehicles in lieu
thereof or in connection therewith both within and
without the borough as in the said Act provided :
And whereas the borough of Nelson adjoins the
borough :
And whereas the mayor aldermen and burgesses
of the borough of Burnley and the mayor aldermen
and burgesses of the said borough of Nelson (in the
preamble to this Act called " the Burnley Corporation "
and " the Nelson Corporation" respectively) are the
owners of systems of tramways light railways and
public service vehicles which with the light railways
and omnibuses or public service vehicles of the Cor-
poration are operated so as to afford a transport
service within and between the borough and the boroughs
of Burnley and Nelson and elsewhere :
And whereas it is expedient that the Corporation
and the Burnley Corporation and the Nelson Cor-
poration should be empowered to combine in the
formation of a joint board committee or other like
body for the joint operation or unified management
of their transport undertakings :
And whereas it is expedient that further and
better provision should be made with reference to
streets and buildings sewers and drains sanitary matters
and human food and otherwise for the local government
health and improvement of the borough and that the
powers of the Corporation in relation thereto should
be enlarged and extended :
And whereas it is expedient that further provision
be made with regard to the finances of the Corporation
and the application of revenue from their under-
takings :
And whereas it is expedient that the other pro-
visions contained in this Act should be enacted :
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas in relation to the promotion of the
Bill for this Act the requirements of the Borough
Funds Acts 1872 and 1903 have been observed :
