The Minister of Agriculture, Fisheries and Food, the Secretaries of State respectively concerned with agriculture in Scotland and Northern Ireland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred upon them by sections 1 and 35(3) of the Agriculture Act 1957(a), as read with the Transfer of Functions (Wales) Order 1969(b), and of all other powers enabling them in that behalf, with the consent of the Treasury and after consultation with such bodies of persons as appear to the said Ministers to represent the interests of producers of cereals, hereby make the following order:—

Citation, commencement, interpretation and revocation

1. This order may be cited as the Cereals (Guarantee Payments) Order 1971, and shall come into operation on 1st July 1971.

2.—(1) In this order, except where the context otherwise requires—

"the appropriate Minister" means—

(a) in relation to England, the Minister of Agriculture, Fisheries and Food;

(b) in relation to Scotland and Northern Ireland, respectively, the Secretary of State concerned with agriculture therein; and

(c) in relation to Wales—

(i) for the purpose of the making, receipt or recovery of any payment, the Minister of Agriculture, Fisheries and Food;

(ii) for all other purposes, that Minister and the Secretary of State for Wales, acting jointly;

"cereals" means wheat, rye, oats or barley;

"determined" means determined by the Minister with the approval of the Treasury and as respects any guaranteed price to be determined in pursuance of this order means so determined by the Minister from time to time in the light of the conclusions of the Ministers from a review held under section 2 of the Agriculture Act 1947(c);

"guaranteed price", "target indicator price" and "average realised price" mean the prices determined or ascertained pursuant to article 3(1)(a) and (b) and (2) respectively of this order;

"the Minister", in relation to any part of the United Kingdom, means either the appropriate Minister in relation to that part, or that Minister and any or all of the other Ministers acting jointly;

"the Ministers" means the Minister of Agriculture, Fisheries and Food, the Secretaries of State respectively concerned with agriculture in Scotland and Northern Ireland and the Secretary of State for Wales, acting jointly;

"registered grower", in relation to any cereals, means the person for the time being registered by the Minister, in such manner and subject to such conditions as he may from time to time specify, as...
