CHAPTER v
An
Act to empower the lord mayor aldermen and citizens
of the city of Cardiff to construct works for the reclama-
tion of and to reclaim certain lands from the foreshore
and bed of the sea and to acquire. lands for those
purposes to confer further powers on them and to
make further provision with regard to lands streets
and buildings and the health local government welfare
improvement and finances of the city and for other
purposes. [2nd March 1961.]

HEREAS the city of Cardiff (hereinafter referred to as
" the city ") is a county borough under the management
and local government of the lord mayor aldermen and
citizens of the city (hereinafter referred to as" the Corporation "):
And whereas it is expedient that the Corporation should be
empowered to construct the works authorised by this Act for the
purpose of reclaiming certain lands from the foreshore and bed of
the sea and to acquire lands for those purposes:
And whereas it is expedient that further and better provision
should be made with reference to lands streets and buildings and
the health local government welfare and improvement of the city
and that the powers of the Corporation with regard thereto should
be enlarged as in this Act provided:
And whereas it is expedient that the provisions with regard to
the
finances
of the city which are contained in this Act should be
made and that the Corporation should be empowered to borrow
for the various purposes of this Act:
And whereas it is expedient that the other provisions contained
in this Act should be enacted:
And whereas the purposes of this Act cannot be effected with-
out the authority of Parliament: 1

And whereas estimates have been prepared by the Corporation
of the expense of the works and purposes hereinafter mentioned
and such estimates are as follows: £
For the purchase of
lands
and easements .. 200
For the construction of works for the reclama-
tion of land 78,800
For the construction of a sewer and sewer
outfall 20,000
And whereas the works included in such estimates are perma-
nent works and it is expedient that the cost thereof should be
spread over a term of
years:
And whereas a plan and sections showing the lines or situations
and levels of the works by this Act authorised such plan showing
also the lands which the Corporation may acquire or use under
the powers of this Act and a book of reference to such plan
containing the names of the owners or reputed owners lessees
or reputed lessees and of the occupiers of all such lands and
describing the same have been deposited in the office of the Clerk
of the Parliaments House of Lords and in the Private Bill Office
of the House of Commons and with the town clerk of the city
which plan sections and book of reference are in this Act referred
to respectively as the deposited plan the deposited sections and
the deposited book of reference:
And whereas in relation to the promotion of the Bill for this
Act the requirements of Part XIII of the Local Government Act
1933 have been observed:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the Queen's most Excellent Majesty by and
with the advice and consent of the Lords Spiritual and Temporal
and Commons in this present Parliament assembled and by the
authority of the same as follows (that is to say):

In this Act the several words and expressions to which Interpretation.
meanings are assigned by the Act of 1936 have the same respective
meanings unless there be something in the subject or context
repugnant to such construction.
(2) In this Act unless otherwise expressly provided or the
subject or context otherwise requires
" the Act of 1919 " means the Acquisition of Land (Assess-
ment of Compensation) Act 1919;
" the Act of 1933 " means the Local Government Act 1933;
" the Act of 1936 " means the Public Health Act 1936;
" the Act of 1947 " means the Town and Country Planning
Act 1947;
" the Act of 1952 " means the Magistrates' Courts Act 1952;
"the Act of 1955 " means the Food and Drugs Act 1955;
" the appointed day " has the meaning assigned to it by
section 97 (The appointed day) of this Act;
" the city " means the city of
Cardiff;
"
the
commission " means the British Transport Commission;
"the Corporation " means the lord mayor aldermen and
citizens of the city acting by the council;
" the council" means the council of the city;
" daily
fine
" means a fine for each day on which an offence
is continued after conviction;
" enactment" includes an enactment in this Act or in any
general or local Act and any order byelaw scheme or
regulation for the time being in force within the city;
" the general rate fund " means the general rate fund of the
city;
" the Lands Clauses Acts" means the Lands Clauses Acts
as modified by the Act of 1919 the Lands Tribunal Act
1949
the Town and Country Planning Acts 1947 to 1959
and this Act;
" magistrates' court " has the same meaning as in subsection
(1) of section 124 of the Act of 1952;
" the Minister " means the Minister of Housing and Local
Government;
" Minister of the Crown " has the same meaning as in the
Ministers of the Crown (Transfer of Functions) Act 1946;
