Act, 1959
CHAPTER xliv
An Act to empower the British Transport Commission to
construct works and to acquire lands and the Liverpool
Corporation to defray the cost of certain works to
authorise the closing for navigation of portions of
certain inland waterways to repeal and amend certain
enactments relating to Holyhead Harbour to authorise
the Commission to guarantee loans to certain pilotage
authorities to make provision in respect of certain
charges in connection with the undertaking of the
Fishguard and Rosslare Railways and Harbours
Company to extend the time for the compulsory
purchase of certain lands to confer further powers on
the Commission and for other purposes.

HEREAS by the Transport Act
1947
the British Transport
Commission
(in this Act
referred to
as
" the Commission ")
were
established:
And whereas it is the general duty of the Commission under
the Transport Act 1947 as amended by the Transport Act 1953
(inter alia) to provide railway services for Great Britain to provide
or secure the provision of
an
adequate and properly co-ordinated
system of passenger transport for
the
London Passenger Transport
Area and to provide in such places and to such extent as may
appear to the Commission to be expedient facilities for traffic on
inland waterways and port facilities due regard being had to
efficiency economy and safety of operation and to the needs of
the public and of agriculture commerce and industry: 1

And whereas it is expedient that the Commission should be
empowered to construct the works authorised by this Act and to
acquire the lands referred to in this Act:
And whereas the construction of
the
works in the urban district
of Ffestiniog authorised by this Act will provide an alternative
railway route from other parts of
the
country to the nuclear power
station to be constructed at Trawsfynydd and it is expedient that
the lord mayor aldermen and citizens of the city of Liverpool
should be authorised to defray the whole or any part of the cost
of the construction of such works:
And whereas the Commission are the owners of the waterways
known respectively as the Birmingham Canal and the Kensington
Canal:
And whereas there has not for some time past been any traffic
on the portions of the said respective waterways in this Act
mentioned and it is expedient that the Commission should be
relieved of their obligations to maintain the same for navigation:
And whereas the Commission are the port and harbour
authority for Holyhead Harbour including the outer harbour
which was originally constructed as a harbour of refuge and is
not adapted for commercial use:
And
whereas
the importation at Holyhead of crude
oil
petroleum
and petroleum products in bulk is under consideration by
important industrial interests:
And whereas the said outer harbour is capable of accommoda-
ting very large tankers at any state of the tide but there are no
facilities thereat for berthing or discharging such vessels and the
same is very little used for commercial or any other purposes:
And whereas it is expedient that the Commission should be
authorised to provide such facilities at the said outer harbour and
to improve and develop the same as
a
port for
the
accommodation
of large tankers and the shipping and unshipping from such
vessels of crude oil petroleum and petroleum products:
And whereas it is expedient that the enactments relating to
Holyhead Harbour should be amended and that additional
powers should be conferred on the Commission in relation to
the said harbour as in this Act provided:
And whereas the docks of the Commission at Port Talbot and
Swansea are within the pilotage districts of Port Talbot and
Swansea respectively and the provision of efficient pilotage
services in the said districts is essential to the operation of the
said docks:
And whereas the Port Talbot Pilotage Authority and the
Swansea Pilotage Authority require to replace their existing pilot
cutters but are unable to finance the purchase of new vessels
without guarantees for the repayment of the necessary loans:

And whereas it is expedient that the Commission should be
authorised to give guarantees for the benefit of the said pilotage
authorities for the purposes aforesaid:
And whereas under an agreement which was scheduled to and
confirmed by the Fishguard and Rosslare Railways and Harbours
Act 1899 the harbour and railway at Fishguard of the Fishguard
and Rosslare Railways and Harbours Company and the vessels
of the said company plying between Fishguard and Rosslare are
worked managed and maintained by the Commission but doubts
have arisen as to the application of the Transport Act 1947 and
of charges schemes thereunder to the charges made in connection
with the said harbour and railway and it is expedient that such
doubts should be removed and also that the charges for carriage
by the said vessels should be deemed to be charges of the
Commission:
And whereas it is expedient that the period now limited for
the compulsory purchase of certain lands should be extended
as provided by this Act:
And whereas it is expedient that the other powers in this
Act contained should be conferred upon the Commission and
that the other provisions in this Act contained should be enacted:
And whereas plans and sections showing the lines or situations
and levels of the works to be constructed under the powers of
this Act and plans of the lands authorised to be acquired or
used by this Act and a book of reference to such plans containing
the names of the owners and lessees or reputed owners and
lessees and of the occupiers of the said lands were duly deposited
in the office of the Clerk of the Parliaments and in the Private
Bill Office of the House of Commons and with the clerks of the
county councils of the several counties and the town clerks of
the several county boroughs within which the said works will be
constructed or the said lands are situated which plans sections
and book of reference are respectively referred to in this Act as
the deposited plans the deposited sections and the deposited
book of reference:
And whereas the purposes of this Act cannot be effected
without the authority of Parliament:
May it therefore please Your Majesty that it may be enacted
and be it enacted by the Queen's most Excellent Majesty by
and with the advice and consent of the Lords Spiritual and
Temporal and Commons in this present Parliament assembled
and by the authority of the same as follows:
