Act, 1929.
CHAPTER xxxviii.
An Act to empower the lord mayor aldermen
A.D.
1929.
and citizens of the city of Birmingham to
construct street improvements and a tramway
to extend their limits and those of the East
Worcestershire Waterworks Company for the
supply of water to enlarge their powers in regard
to their savings and housing bank and to make
further provision in regard to their several
undertakings and to the health local government
and improvement of the city and for other
purposes. [20th December 1929.]

HEREAS it is expedient to empower the lord
mayor aldermen and citizens of the city of
Birmingham (in this Act called "the Corporation") to
construct the street improvements and tramway described
or referred to in this Act and to enlarge their powers
with regard to the acquisition retention development
and disposal of lands :
And whereas an agreement has been entered into
between the Corporation and the East Worcestershire
Waterworks Company a copy of which is set forth in the
First Schedule to this Act and it is expedient to confirm
the agreement and to extend the limits of the Corporation.
and of the said company for the supply of water and to
make further provision with regard to the water
undertaking of the Corporation :

And whereas it is expedient to authorise the making
of town planning schemes as respects land in the city
which is wholly or partly developed and to make further
provision in relation to the health local government and
improvement of the city:
And whereas by the Birmingham Corporation Act
1919 the Corporation were empowered to establish a
savings and housing bank and it is expedient to enlarge
the powers of the Corporation in regard thereto :
And Avhereas it is expedient that the other provisions
contained in this Act be enacted:
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas estimates have been prepared by the
Corporation for the purposes hereinafter mentioned and
such estimates are as follows : £
(a) For the purchase of lands and
buildings for the purposes of this Act 60,666
(b) For the construction of the new street
and street improvements authorised
by this Act and the works incidental
thereto 47,028
(c) For the construction and electrical
equipment of the tramway authorised
by this Act 18,930
And whereas the several works included in such
estimates respectively are permanent works and it is
expedient that the cost thereof should be spread over a
term of years :
And whereas in relation to the promotion of the
Bill for this Act the requirements of the Borough Funds
Acts 1872 and 1903 have been observed:
And whereas plans and sections showing the lines
and levels of the works authorised by this Act and a
book of reference to those plans containing the names
of the owners and lessees or reputed owners and lessees
and of the occupiers of the lands required or which may
be taken for the purposes or under the powers of this
Act were duly deposited with the clerks of the peace for

the city and for the county of Warwick respectively and A.D. 1929.
are in this Act respectively referred to as the deposited
plans sections and book of reference:
May it therefore please Your Majesty that it may be
enacted and be it enacted by the King's most Excellent
Majesty by and with the advice and consent of the
Lords Spiritual and Temporal and Commons in this
present Parliament assembled and by the authority of
the same as follows (that is to say):

PRELIMINARY.
1.
This Act may be cited as the Birmingham Short and
Corporation (General Powers) Act 1929 and the Birming- collective
ham Corporation Acts 1876 to 1927 the Birmingham titles-
Corporation (Rivers Improvement) Act 1929 and this
Act may be cited jointly as the Birmingham Corporation
Acts 1876 to 1929.

This Act is divided into Parts as follows : Division

Part V.—Water.
Part VI.—Streets buildings and sanitary

Part XII.—Miscellaneous.
3.
The following enactments (so far as the same are Incorpora-
applicable for the purposes and are not inconsistent with tion of Acts.
the provisions of this Act) are hereby incorporated with
this Act (namely):
(1) The Lands Clauses Acts with the following
exception and modification :
(a) Section 127 of the Lands Clauses Con-
solidation Act 1845 is not incorporated with
