CHAPTER cxxii.
An Act to confer further power.s upon the lord
A.D.
1935.
mayor aldermen and citizens of the city of
Birmingham to make further provision in regard
to the health local government and improvement
of the city and for other purposes.
[2nd August 1935.]
W
HEREAS it is expedient to confer further powers
upon the lord mayor aldermen and citizens of the
city of Birmingham (in this Act called " the Corporation ")
relative to the construction of street improvements
the acquisition of land for the erection of municipal
buildings and other purposes and the running of trolley
vehicles:
And whereas the Corporation have adopted the
Local Government and other Officers' Superannuation
Act 1922 and under section 24 of that Act and section 27
of the Widows' Orphans' and Old Age Contributory
Pensions Act 1925 a scheme entitled " the Birmingham
Superannuation Scheme 1926 " has been made by the
Corporation and approved by the Minister of Health
and it is expedient to make further provision in refer-
ence to the granting of superannuation allowances to the
officers and servants of the Corporation and to confirm
the trust deed which as amended by this Act is set forth
in the First Schedule to this Act for the establishment
of a fund for providing pensions for the widows and
orphans of such officers:

1935. And whereas it is expedient to make further
provision with reference to the health local government
and improvement of the city:
And whereas it is expedient that the other
provisions contained in this Act be enacted :
And whereas the purposes of this Act cannot be
effected without the authority of Parliament:
And whereas estimates have been prepared by the
Corporation for the following purposes £
(a) The purchase of lands and buildings
for the purposes of this Act - - 299,000
(6) The construction of the street im-
provements authorised by this
Act and the works incidental
thereto 97,000
(c) The provision of trolley vehicles - 17,000
(d) The provision of electrical equip-
ment and the construction of other
works necessary for working the
trolley vehicle route authorised
by this Act 21,890
And whereas the several works included in such
estimates respectively are permanent works and it is
expedient that the Corporation should be empowered to
borrow money for those purposes as provided by this
Act:
And whereas in relation to the promotion of the
Bill for this Act the requirements of Part XIII of the
Local Government Act 1933 have been observed :
And whereas plans and sections showing the lines
and levels of the works authorised by this Act and also
a book of reference containing the names of the owners
and lessees or reputed owners and lessees and of the
occupiers of the lands required or which may be taken
for the purposes or under the powers of this Act and
plans showing the footpaths to be made and the
footpaths to be stopped up under the powers of this
Act were duly deposited with the town clerk of the
city and the clerk of the Warwickshire County Council
which plans sections and book of reference are in

this Act respectively referred to as the deposited plans A.D. 1935.
sections and book of reference :
May it therefore please Your Majesty that it
may be enacted and be it enacted by the King's most
Excellent Majesty by and with the advice and consent
of the Lords Spiritual and Temporal and Commons in
this present Parliament assembled and by the authority
of the same as follows (that is to say):

This Act may be cited as the Birmingham Short and
Corporation Act 1935. collective
(2) The Birmingham Corporation Acts 1876 to
1929 and this Act may be cited jointly as the
Birmingham Corporation Acts 1876 to 1935.
, This Act is divided into Parts as follows :
Part I.—Preliminary.
Part II.—Lands.
Part III.—Trolley vehicles.
Part IV.—Street improvements.
Part V.—Streets buildings sewers
drains.
Part VI.—Sanitary matters.
Part VII.—Police.
Part VIII.—Private employment agencies.
Part IX.—Superannuation.
Part X.—Finance.
Part XI.—Miscellaneous provisions.

3.
The Lands Clauses Acts (so far as the same are Incorpora-
applicable for the purposes of and are not varied by or *ion of
inconsistent with this Act) are hereby incorporated ^dss
with and form part of this Act with the following A^*
exceptions and modifications :
(a) Sections 127 to 132 inclusive of the Lands
Clauses Consolidation Act 1845 are not
incorporated with this Act;
