HEREAS within the Manor of Barhjlttnd-;. in. the Parifh ol
Halifax, in the County of Fork, there are divers Commons,
Moors,'and'Wafte Grounds, called Wjfiet; MiW,
Gallipots
Hill,
dohey Garth Hill, Hillhoufe Hill, Barkijtand
Cvofss,
Height
Common,
Ring,
Jione Edge, Brick Green, Hileyl Hill, Flockims Cliff,Hill,
Horfe,
Bqjiwey
Whole Stones, Wit hens Pike, Law andBog
Holes,
containing together One
tho'ufand Acres or thereabouts; and various other Parcels of Wafte not
diftinguifhed by any particular Name": And whereas' the Honourable and
Reverend John Lumley Savile,. is Lord of the Manor of: Barki/land afore.-.
faidj and Owner of the Soil' of the faid'fe.veral Commons,: Moors, and
Wafte^Grounds, and alfo of the Coal'Mines^ Veins; and Seams of Coal,
and all other Mines and Minerals therein, and is .likewife Owner of. cer-
tain Lands, Tenements, and Hereditaments; within the faid Manon of
Barkijland'.••
And whereas the King's moft Excellent Majefty, in Right
of His Crown, is Patron of the Vicarage;of Halifax', and the Reverend

entitled to the Tythe of Agistment* and all other Vicarial or-Small Tythes
whatfoever within the faid Manor of Barki/land-!.And. whereas the faid

faid Commons, Moors, and Waftes : And whereas an Ad was paffed in
the Forty-firft Year of the Reign of His prefent Majefly, intituled An Aft
for
consolidating
hiOne Aft, certain Provifions ufually inferted in Afts of
Inclofure, and for facilitating the Mode of proving the feveral Faih ufually
required
.on
the faffing of fuch Acls: And whereas the faid Commons,
Moors, and Wafte Grounds, afford little Profit or Advantage in their
prefent State ; but it would be very advantageous to the feveral Perfons
interefted -therein, if fuch Commons, Moors, and Waftes were divided
and inclofed, and fpecific Shares allotted to them, according to their re-
fpe&ive Interefts therein ; but fuch Divifion and Inclofure cannot be effected
and eftablifhed without the Aid and Authority of Parliament: May it
therefore pleafe Your Majefly that it may be enafted ; and be it enadted
by the King's molt' Excellent Majefty, by and with the Advice and Con-
fent of the Lords Spiritual and Temporal, and Commons, in this prefent
Commiflion- Parliament affembled, and by the Authority of the fame, That all the faid
trsappointed. Commons, Moors, and Wafte Grounds, fhall as foon as conveniently may
be,
be fet'out, divided, and 'allotted, by Thomas Gee of Little Houghton,
in the Parifh of Darfield, in the faid County of Tork, Gentleman, and
Jonathan Taylor of Leeds, in the faid County, Gentleman, who are hereby
appointed Commiffioners for that Purpofe, and for carrying the feveral
Purpofes of this Aft and the faid,recited Aft into Execution (except fuch
Parts of the faid recited Aft as are hereby altered or varied) unto and
amongft the faid feveral Owners and Proprietors, and other Perfons inte-
refted, according to their refpeftive Rights, Shares, and Interefts therein ;
under and fubjeft to the Directions herein contained, and to fuch of the
Rules,
Orders, Regulations, Reftriftions, and Directions contained in
the.foid'recited'Aft, as are not repugnant to, or varied orcontrouled by,
or other-wife provided for
by.

Aft j and that it fhall be lawful for the
faid Commiffioners, or either of them, or for any Jullice of the Peace for the
Weft Riding, of the County of Tork, to adminifter to the faid
Commif-
fioners,' or either of them, the Oath of Affirmation direfted by the faid
retited Aft to be taken by Commiffioners.
Appointment II. And be it further enafted, That if the faid Thomas Gee, or any
of newborn- Gommiffioner to be appointed in his Stead, as herein-after mentioned, by

of the faid Manor for the Time being, fhall die, refufe, or be-
Death, kc. come incapacitated to aft, then and in every fuch Cafe the Lord of the faid
Manor for the Time being fhall and may thereupon appoint a new Cqm-
mifliorier, not interefted in the faidTnclofure, in the Stead of the faid
Thomas'
Gee, or of fuch Commiffioher fo dying, refufing, or becoming
incapacitated to aft; and if the faid Jonathan Taylor, or any Commiffioner
to be appointed by the Majority in .Value of the Perfons interefted in the
faid Lands, prefent at a Meeting, as herein-after mentioned, fhall die*
refufe, or become incapacitated to.aft, a new CommifTioner,'not interefted.
in the faid Inclofure, fhall and may- be thereupon appointed in the Stead of
the faid Jonathan Taylor, or of .'any fuch Commiffioner dying, refufing, or
becoming incapacitated to aft, by a Majority in Value (to be afcertained
by the Land Tax Affeffment) of the Perfons interefted in the Lands hereby
iritended to be divided and inclofed, who fhall be prefent at a Meeting to
beholden for that Purpofe in the Chapel of Ripponden, in the Townfhip
oi-Barkifland, purfuant to Notice to be affixed upon the principal outer
Dodr.'of the faid Chapel of^, Ripponden, fpecifying the Time and Place of
